An exception to this rule is if the employer has intentionally put his employees at risk by ignoring health and safety guidelines, not providing the correct safety equipment (for example, safety goggles or guards, helmets or the appropriate safety signs). Knowingly exposing workers to dangerous chemicals or asbestos is another example. In these cases, the injured party can sue.

If the amount the employer issued could be awarded exceeds that of workers’ compensation, monies can cover medical expenses, vocational rehabilitation fees, loss of earnings and property damage. Worker’s compensation doesn’t include punitive damages or payment for pain and suffering.
